La verdad es que el tema es bastante interesante, no se si será todo verdad pero desde luego de serlo la asociación de internautas nos ha echo un flaco favor con sus campañas de No al canon

Yo personalmente podria estar de acuerdo en darle algun tipo de retribucion,como este canon que estamos pagando, a los artsitas o a las empresas que promueven a éstos y a las empresas de software, con lo que no estoy de acuerdo es con que una sociedad privada como la SGAE se esté forrando con la excusa de retribuir a los que anteriormente he mencionado,para mi esos tios no son mas que buitres acechando alrededor de todo lo que tenga derechos de autor para sacar tajada sin pensar en nada mas.

Tengo entendido que el canon se paga no solo por los cds y dvds virgenes, qeu son los consumibles de destino, sino tambien por la tecnología capaz de crear esas copias, vease videos con la función de grabar de la televsión, casettes de doble pletina, minicadenas, grabadoras de cds…es decir, que para una hipotetica copia resulta que pagas el canon tantas veces como instrumentos participen en esa copia…y si encima utilizas esa tecnologia para otros fines como ha señalado Pedro en realidad te estan robando y se estaran descojonando de ti…
Hay que tener un poco de memoria historia, cuando apareció la radio, las distribuidoras y todas las macroempresas implicadas en el super negocio de la música auguraron el fin. Que al tener la radio en cada casa la gente se grabaria las canciones, no compraría, no habria dinero para promocionar nuevos artistas, se acabaria la cultura….¿no os suena nada eso?…o tienen poca imaginación con sus argumentos, o este negocio no es tan frágil como nos quieren hacer creer…
¿Aumentar en subir la cuota de banda ancha con este impuesto indirecto? me parece bien, tan pronto como la relación calidad precio de los operadores españoles se iguale a la de nuestros vecinos europeos. Que pagamos mas o menos lo mismo y a ellos les va mucho mejor…después dios dira.

En otros sittios he oido que ya hay empresas que estan utilizando esta actividad emergente de internet para promocionar grupos y dar a conocer su música, precisamente lo contrario que auguran desde la SGAE. Yo creo que no es un problema de cambios, sino de miedo al cambio. Las nuevas tecnologias ofrecen nuevas actividades y por tanto nuevas competencias entre unos y otros.

veamos, si lo que deciis es cierto, el canon es indiscriminado, te cobran cuando grabas un CD que no tiene nada que ver, etc. pero es que os voy a intentar dejar las cosas mas claras, o canon o no hay copia privada.

los beneficios de descargar son mucho mayores. estar en contra del canon no es mas que una moda que nos han impuesto. el que el sistema debe retocarse, estoy de acuerdo. igual que quieren poner gasoil profesional, se ponen CDs profesionales (que ya existen, no permiten grabar música y ya esta) y del mismo modo que no lo gestione la SGAE (una entidad privada) sino una entidad pública.

Vamos a ver. Si es legal ¿Por qué penalizarlo? También al frutero de la esquina de mi bloque le jorobó que pusieran un súper al lado, pero ni se la ocurrido ir a reclamar nada porque el descojono sería de aupa.

Y si es ilegal que lo digan claramente: “mira puedes comprarte el CD de noséquién pero no puedes hacer ni una copia. Ni uso privado ni gaitas” En ese caso tampoco debería poderse grabar películas o música de la tele y no sé muy bien qué pasaría con los reproductores mp3 y los aparatos grabadores. Seguro que los fabricantes tendrían algo que decir ahí. Y los vendedores.

Veamos, como tu dices la copia es una realidad fáctica que se puede realizar no solo desde internet sino también desde la televisión con aparatos grabadores, desde la radio etc. Por ello, nuestro legislador decidió permitir la copia privada. Ahora bien, el fundamento para permitirla, la razón por la que puede exigir la copia privada (que técnicamente no es mas que un permiso para “robar” (entiendase muy entre comillas)) es porque se estableció un canon remuneratorio, sin canon no puede haber copia privada.

Yo te quiero hacer una pregunta: El canon rige por toda España y Europa, por cada producto que consumas, sin importar su utilizacion, no? Y que pasa con el resto del globo? Me pregunto si funciona algo parecido aca en Chile, porque en materia de derechos de autor, no hay muchas leyes que protejan la propiedad intelectual mas que lo que estipula la Carta Fundamental sobre esta. EL mercado musical chileno va decayendo cada vez mas y mas y las autoridades -todas en general- abordan el tema con soluciones de parche. Quizas donde vamos a parar.

Sabes como se llama el autor de la cancion “Un Año Mas”, aquella que baila todo chileno para las ocasiones de año nuevo y cumpleaños afines? Lo unico que se es que el pobre hombre vive en una poblacion periferica al N. de nuestro pais, con sus instrumentos en mal estado y obteniendo una pension equvalente casi a la tercera parte del sueldo minimo mensualmente. Por lo visto el no se ve beneficiado con el Canon. En que mundo vivimos hombre! Si esto pasa tanto en tu patria como en la mia!

el canon no se aplica a todos los productos, solo a los directamente relacionados con el tema, que vendrían a ser las conexiones de banda ancha y CDs/DVDs virguenes.

de igual modo, no se aplica en todo el mundo, solo en España, pues es una entidad española la que lo recauda. En chile no cobran este impuesto, ni lo reparten entre los cantantes chilenos.

Estar en contra del canon para mi no es una moda. Paso de ramoncín y de triunfitos, paso de bajar MP3 (sobre todo porque entre mis favoritos están John Williams y Bach, y ya es bastante la pérdida de calidad que tienen en CD), y todos los juegos a los que juego habitualmente o son gratuítos o los he pagado (no tengo tiempo para jugar mucho, todo sea dicho).

Uso los DVDs para datos de la empresa, distribuciones linux (que al final se me amontonan sin instalarse, es verdad…), fotos, películas caseras (en un sistema 5.1 los divx descargados se oyen bastante mal, prefiero disfrutar de las películas, y tengo una cabina de alquiler en mi portal prácticamente…), y estos señores me pretenden no solo cobrar, sino criminalizar por ello…

Por cierto, el derecho a la copia privada es prácticamente imposible de ejercer… si trato de copiar cualquiera de los CDs o DVDs originales que tengo, la copia me sale con errores. Incluso algunos CDs de música vienen protegidos.

Me gustó bastante como expusiste tu opnión; eres la excepción que confirma la regla. Permite que me explique.

El concepto de canon solo funciona si realmente hay un daño (que lo hay si se descarga por internet) y solo tiene lógica si lo que se recupera es más o menos del mismo valor de lo que se pierde. En tu caso el canon es inútil porque tu no descargas/copias CDs y porque todos sabemos que el canon de la SGAE está muy exagerado.

Estas cosas podrían tratarse de todos modos, no tiene porque llevar el canon la SGAE, no tiene porque aplicarse a los CDs directamente (podría cargarse a las conexiones de ADSL que en plena lógica no superan los 256 Kb si no es para descargar por p2p a menos que seas una empresa, y eso se podría constatar). Son retoques del sistema que se pueden mirar.

Ahora bien el canon es necesario para mantener la copia privada y no pienso renunciar a ella bajo ningún concepto, o sino si que criminalizaran cualquier copia privada y descarga.

Justificas el concepto de pago de un canon como compensacion economica por ejercer nuestro derecho constitucional a la copia privada

Bien, aceptando que ejercer ese derecho produce perdidas economicas tenemos que centrarnos en a quien se le producen esas perdidas

- Por un lado pierde la industria : directamente las Discograficas, Productoras de Cine …. indirectamente las Distribuidoras , Vendedores Mayoristas, Tiendas , cines…. al no recibir sus correspondientes ingresos por tus descargas

- Por otro lado pierde el autor al no recibir su tanto por ciento

Ahora bien , a quien va dirigido el beneficio que produce el canon? unica y exclusivamente al autor a traves de sus gestoras de derechos ($GAE) quedandose estas con una gran tajada y haciendo un mal reparto de la pasta… aunque esta es otra larga historia

Asi pues los otros damnificados (La Industria) se quedan sin compensacion , luego el canon no es solucion y siguendo tu planteamiento el derecho a copia privada sigue en peligro

Me levanto por la mañana, voy a un bar me tomo una cerveza y de mientras oigo el nuevo disco de Extremoduro , decido que me gusta y que lo quiero comprar…. me pillo un taxi para ir a la tienda de discos a pillarmelo (que pasa esta lejos y paso del bus ) en el taxi la radio va puesta y casualmente estan radiando unos temas del disco de Extremoduro… llego a la tienda me compro el disco y decido comprarme un reproductor de CD´s nuevo, ya que el mio ya esta viejillo….

a que viene esta historia? viene a que en los 4 casos en que me toca acoquinar pasta , parte de ella va para los señores que componen en Extremoduro ,
1 en el bar , el tasquero paga anual o mensualmente (no lo se de fijo) a la $GAE por reproducir obras protegidas
2 en el taxi, el taxista tambien paga a la $GAE por llevar una radio en el taxi
3 Al comprar el disco, las discograficas al fabricar los discos pagan su correspondiente tasa a la $GAE
4 al comprar el reproductor de CD, estos aparatos estan grabados con una tasa que se lleva la $GAE

toda esta gente que paga a la $GAE , al hacer sus calculos de beneficios (poner los precios de venta) tienen que calcular sus gastos, incluida la factura de la $GAE, y cargarlos al precio de venta final… es decir en todos los casos quien paga esas tasas es el usuario final… totalmente ridiculo
yo creo que cuando un autor hace una obra y decide venderla en el momento de cobrar ya deberia de quedar contento , no entiendo porque tiene que seguir cobrando , es como si yo cuando fabricaba sillas , despues de venderlas siguiese cobrando a cada persona que se sentase en ellas

Veamos, la copia privada NO es un derecho constitucional. Es un derecho derivado de una ley. Segundo, la copia privada no puede existir sin un canon, es un principo básico del derecho, no se puede permitir lo uno sin lo otro. Y finalmente, el que haya canon no conlleva que haya SGAE. Yo nunca he defendido en mis tesis que la SGAE lo este haciendo bien, ni que deba seguir haciendolo. Lo que he dicho es que debe seguir habiendo canon, que es justo y que encima es un chollo.

El que luego lo gestione la SGAE y el propio ministerio de cultura es un asunto distinto, y creo que aquí si que habrá pocos que opinen que la SGAE lo está haciendo bien. Yo soy partidario de eleminar ese derecho de la SGAE y que lo controle el ministerio de una forma trasparente (si bien pánico me da pensar eso de ministerio + transparente).

No se a que llamaras sindrome $GAE :D, si te refieres a sentir aversion total hacia esa “gente” , pues si :) :p , me viene desde hace unos 15 años , yo tuve una compañia discografica (mis discos estan en emule, puestos por mi) y forme parte de otra y siempre evitamos en la medida de lo posible dar un duro a esa reminiscencia del franquismo (es lo que es) solo trabajabamos con grupos que no fuesen socios y si lo eran les pediamos que fuesen ellos quienes pagasen la tasa que nos imponia la $GAE por editar los discos

Es que no estás viendo el planteamiento; yo hablo de abajo hacia arriba, del ciudadano al Estado. El canon es lo que me asegura mi derecho de copia privada. Luego el canon tiene otro efecto, el descendente, del Estado a los perjudicados. Eso ya no es un tema, como decirlo, político, es una mera cuestión técnica que para solucionarla habría que examinar la situación por una organización sin ánimo de lucro (el que diga que la SGAE lo és está ciego) y se solventa a partir de ahí.

En esos temas tampoco me aventuro tanto a establecer manifiestos porque no los conozco desde dentro, pero supongo que de crearse un consejo de Estado para la protección de la música podría establecerse un canon remuneratorio directamente pagado del Estado a cada artista por el % de conciertos que hacen o el nº de asistentes (parece el dato más significativo del éxito que tiene uno u otro). Y luego dar otro % a las distribuidoras, que lamentablemente no creo que lo necesiten porque si en el mundo solo hay 5y las 5 tienen beneficios absurdos (pero como para montar un ejército ellas solas, ganan burradas) no se hasta que punto se hacen las mártires y luego cobran a escondidas. Pero aún y así, se les da un % y listos, eso si, uno justo.

Lo mejor de pagar un canon antipirateria, es que es una forma de legalizar la susodicha pirateria.

Gran falacea: grabar cd -> piratería:

Grabar un cd no siempre implica ser un acto de piratería, por ello no deben implantar el canon en los cds vírgenes, creo que se debe luchar contra la piratería utilizando otros métodos más directos contra los que la promueven.

Ejemplo… ¿Porqué si me compro un cd para grabar las fotos de mi cámara digital parte de mi dinero siempre va a la SGAE?… Esto es un chollo para algunos de los componentes de esta organización que se han ganado un sueldo fijo sin haber tenido una gran carrera profesional… y en algunos casos incluso efímera

a ver, sin ánimo de ofender, creo que no entiendes el concepto de canon. un canon es precisamente un impuesto indiscriminado que se va a cargar sobre un tipo de cosas en general, afectando también a cosas que no son las que pretendes cargar. en este caso a cambio ganas el derecho de copia privada, que sin canon no puede existir.

contra la pirateria hay otra forma de luchar, la de los paises anglosajones, no poner canon e ilegalizar la copia privada, que incuye la ilegalización de la descarga por internet de cualquier contenido. para mi esto sería intolerable y un corte a nuestra cultura drástico. es más, el mero hecho de llevar un CD grabado por ti en el coche sería un delito si no acreditas tener esos discos comprados.

Estoy rotundamente de acuerdo con el canon, porque sencillamente lo queremos todo sin dar nada a cambio, o sea todo por la cara, acepto de buen grado el canon a cambio de poder descargar lo que me venga en gana sin más.

Si al canon, a cambio que nos dejen descargar lo que cada uno quiera de internet, sencillamente, me parece muy bien contribuir de alguna manera.

Mmmm ¿Qué hay de la presunción de inocencia? El canon es un gravamen basado en estadísticas. Enfocado en líneas generalistas sí tiene su sentido moral (y legal aún lo dudo) a sabiendas que el mayor porcentaje de cd’s quemados llevan contenido con copyright. Pero en situación individual, directamente es una ilegalidad cobrarme para paliar “un delito” que no sabes que voy a cometer. Grabar datos personales ¿Pagamos a la SGAE por eso? Es negar la presunción de inocencia. A no ser que el canon no sea un concepto de derechos de autor, sino un impuesto “porque sí” lo cual es tener más cara que espalda y un pufo para no poder rebatirles nada. “Palia daños, pero no en concepto de derechos de autor, por lo cual no te quejes si grabas cosas tuyas”. De todas formas no me parece tan grave, si se consigue paliar los efectos del pirateo. Hay gente que se tira de los pelos con estas cosas, aunque ni su bolsillo lo note, pero es porque tienen SGAEitis, como he leido por ahí.

La presunción de inocencia no es más que un privilegio de derecho procesal, no un derecho absoluto. Y no te equivoques, el canon sí es un impuesto porque sí, a cambio eso sí de permitir la copia privada. No te están grabando por copiar, lo que te están es dando el derecho de descargar todo el contenido audio-visual que desees o que lo copies de amigos sin problemas, al igual que te cargan un impuesto indirecto e indiscriminado sobre cualquier producto (llamado IVA) para poder pagar el estado del bienestar.

Findal, no estoy en contra del canon y además nos conviene, por lo que dices de la copia privada, descargar libremente, etc.

Pero no me convence eso que dices.
¿Desde cuando los impuestos se cobran desde una entidad privada? Desde nunca. La ley permite cobrar a una entidad privada un PALIATIVO por la vulneración de un derecho que les concierne, el copyright. No se puede bautizar como impuesto, sino como compensación o “indemnización” por daños a un derecho. Si te cobran, te están acusando de delincuente previo. Sin admitir que puedas no serlo. Las cosas son como son.

No obstante. mucho más que todo lo anterior me fastidia la demagogia popular de acoso y derribo hacia todo lo que sean unas siglas y la palabra copyright por medio. Y más aún el cuestionamiento de la calidad de determinados artistas en función de si están o no a favor de estos asuntos, o si tienen el carnet de alguna sigla. Me parece una verguenza
que a pesar de que algunas cuestiones son razonables, como lo de la presunción de inocencia, o la de que existen productos sin copyright (4 contados) haya gente que se meta en ese minimalismo del buscar 3 pies al gato y lo use para esgrimir campañas de acoso y derribo.

La cosa es así de simple:

CANON: incremento del 20% en ADSL CD’S HD y regrabadora.

Consecuencias: Descarga libre, copia privada y ahorro de un 1500% del precio de mercado de los artículos que descargas.

Y la gente se tira de los pelos y protesta…manda narices.

PD: Y con lo anterior no pretendo decir que la SGAE es trigo limpio, ni mucho menos. Hay chupones a mansalva. Pero tampoco es trigo sucio “porque sí y punto”
Es que mira si es sencillo reunir masas si lo que se implora es la gratuidad. Las avalanchas de adolescentes clamando al cielo (la mayoría lo son) de la generación del push key y todo hecho, que no saben lo que es un disco de vinilo. En parte me recuerda a los movimientos juveniles nazis, pro etarras y demás.

Francamente, y en mi opinión ya muy personal, me dan pena los que aún siguen agarrandose a un modo de vida anticuado y desfasado de “crear, empaquetar y cobrar”… Hay cosas que no podreis empaquetar y cobrar, cosas que no se pueden enlatar para cobrarlas a muy alto precio, de igual forma que no se puede vender el humo.

No se si sería comparable, pero ¿no sería algo así como si a cada español con carné de conducir le viniera una multa? Son infractores en potencia, pero solo unos pocos son los que se saltan los semaforos y límites de velocidad. ¿No pagan justos por pecadores?

Francamente, estoy cada día más a disgusto con este tipo de sociedad donde yo pago rigurosamente, tengo un trabajo honrado como programador de una empresa de software libre, pago mi hipoteca (abusiva por otro lado y que cierra a muchos la posibilidad de el derecho fundamental a una vivienda digna), mis impuestos, impuestos de circulación para despues tener que pagar también por el derecho de poder aparcar… (pero eso es otra guerra)… Una sociedad donde el que paga es el pobre trabajador y es tratado como un ladrón, y el rico siempre tiene la razón y ‘fabrica’ leyes a su conveniencia para salir impune.

Harto de que se inventen nuevas y más refinadas formas de robarnos, y digo robar porque me quitan lo que no les pertenece.

Si yo todo eso entiendo que sea importante que todo el mundo lo vea, pero no te engañes, mucha gente trabaja para que todo eso exista y si no se les paga no trabajan, ergo no hay más cultura. Evadiendo el debate de si la música o el cine nuevo español es realmente cultura (yo pienso que no xD), lo que no se puede es justificar un delito por interés general.

“No uso software propietario. No tengo música ni cine en mi casa.” - Esta queja también se oye mucho. Las leyes no las hacemos para 1 o 2 personas, se hacen para la mayoría. La mayoría si descarga música y películas (y tristemente mucho software propietario), por eso hay que aplicar el canon para compensarlo. Por si te interesa hay unos nuevos CDs a los que no se les cobra canon que no permiten grabar música en ellos, están en trámites de venderse en España. Personalmente creo que con la nueva LPI (que extiende el impuesto a muchos otros medios) creo que se les ha ido la olla, el canon ahora mismo ya remuneraba muchisimo más de lo que perdían (solo hay que mirar las cuentas de la SGAE), lo que habría que haber echo es ajustarlo un poco más para que cargara cosas que realmente solo use la gente que descargue.

Os veo algo confundidos. Estáis equiparando la copia privada y su correspondiente canon a la piratería: GRAN ERROR.

Habláis de “canon antipiratería”: ENORME ERROR.

Los autores de música y pelis, a través de sus entidades de gestión, recaudan enormes cantidades de dinero en concepto de copia privada. Es decir, según vosotros, esa recaudación les compensa x la piratería.

Ahora bien, la LPI prohibe expresamente la copia privada de software. Esta gente no recibe ningún tipo de compensación x la piratería q sufre, puesto q no existe copia privada y, x ende, canon.

O sea, resulta q los autores de música y pelis son los más privilegiados del planeta xq de entre todos los sectores q sufren piratería, son los únicos a quienes se compensa.
Los demás, los autores de software, el sector textil…., bahh, para qué van a recibir una compensación. Sufren más piratería pero q se jodan, no?

A ver si dejamos las cosas claras, la piratería es un delito castigado en todos los ámbitos. Lo q no se puede pretender es q unos usuarios, x ejercer la posibilidad q les permite la ley a la copia privada, financien las pérdidas x piratería de sólo unos “elegidos”.

Yo tengo una duda, si yo a mi hija la grabo con mi videocamara (legalmente comprada) y quiero almacenar los videos de forma digital, ¿que debo hacer? pagar derechos de autor para ¿poder ver a mi hija?, porque cuando tu vas a la tienda no te preguntan para que quieres el cd-r o el dvd-r, directamente te aplican el canon.

b) La segunda opción es poner medidores de uso de p2p y cobrarnos en base a cuanto p2p usemos, que también se puede hacer, ya se ha planteado, y un internauta normal y corriente que descargue música 3 veces al més y un par de películas acabaría pagando entre 12 y 50 euros, y si descargas más llega hasta los 500€.
